At Englett and Associates, we represent immigrants and organizations before a number of immigration appellate forums, most notably the Board of Immigration Appeals (BIA) and United States Citizenship and Immigration Services (USCIS) Administrative Appeals Office (AAO).
If your case is denied by an immigration court, you have the right to an appeal. It is critical that you obtain experienced legal counsel as a local immigration judge’s decision may not always be correct; however, there are strict deadlines and filing requirements in order to appeal their decision. You could jeopardize your rights if everything is not handled correctly

At Englett and Associates, we will work to ensure that your appeal is filed correctly and within the deadline requirements of the BIA.We will prepare a detailed written argument which supports your case and since it is rare for any hearings to take place during an appeal to the BIA, the written argument can be your best chance to persuade the BIA that the local judge made the wrong decision. Should your case then be denied by the BIA, our experienced team of attorneys can litigate your case before federal appellate courts.

You may also appeal certain denials of petitions that were filed with the USCIS with the AAO. You may be able to file an appeal to the BIA or a Motion to Reopen or a Motion to Reconsider concerning the denials of requests of other immigration benefits before the USCIS. If you have been denied a request for an immigration benefit, it is important to contact an experienced attorney to determine if an appeal to the AAO would be beneficial. If eligible, we will file an application for appeal and prepare a requisite brief in support of your argument seeking to reverse the decision.
