Wage Garnishment

If a creditor is threatening to garnish your wages for non-payment, a Chapter 7 or Chapter 13 bankruptcy will stop the action. Throughout the bankruptcy proceedings you will continue to receive your full wages. If a creditor has already garnished your wages it is possible that your employer has not yet forwarded them, but is holding them pending the bankruptcy outcome. If so, you are entitled to the earnings held back by the employer as well.
