The Fair Labor Standards Act: How Does it Apply to You?

In 1938, the federal government passed the Fair Labor Standards Act (FLSA). This Act and its amendments are responsible for protecting the rights of workers in the United States and it has established requirements for:

minimum wage
overtime pay
child labor laws
Under the FLSA, all employers are required to pay all non-exempt employees the federal minimum wage. The FLSA also states that non-exempt employees are entitled to overtime pay when they work over 40 hours a week. Unlike exempt employees, non-exempt employees are eligible for paid overtime. They must also be compensated for all hours worked during a given week including hours worked from home, travel time, waiting time, job training, and also probationary periods.

Generally, exempt employees are not paid overtime. To be considered exempt an employee:

must be paid on a salaried basis
must have a salary that meets regulation requirements
must have job duties that meet regulation requirements
child labor laws
It is a general misconception that when employees are paid salaries they cannot receive overtime compensation, but there are cases when this is not true. For example, an independent contractor may be paid an annual salary, but still be eligible for overtime pay. Therefore, eligibility for overtime pay will vary on a case-by-case basis.

Overtime Dispute Law

Under the FLSA, employers are required to comply with specific overtime laws. When employers intentionally fail to pay their employees overtime, employees may exercise their legal rights by filing an overtime dispute claim. Employees that win their overtime dispute claims may be paid damages by their employers.
