Non-Compete Agreement

When people start new jobs, they will be asked to fill out paperwork for their companies’ Human Resources Department. Among the stack of paperwork employees may find a non-compete agreement.
Non-compete agreements are legally binding contracts. However, unlike other types of contracts, enforcing non-compete agreements can prevent employees from working at other companies. Basically, an iron clad non-compete agreement can prohibit an employee from taking a job with another company that competes with his or her former employer. Usually, these agreements have geographical, time, or industry limits that are enforceable once an employee signs his or her name on paper.

The Limits of Non-Compete Agreements

Once employees have signed non-compete agreements, they may:

Be prohibited from working within a certain radius of their former employer’s work site
Be prohibited from working within the same industry as their former employer for a set period of time
Be prohibited from revealing confidential information or trade secrets about their former employers
While these contracts may present specific terms and are legal it is important to note that the enforceability of non-compete agreement varies from state-to-state. For example, in the state of California, non-compete agreements are prohibited. However, in Florida, non-compete agreements happen to be common. If you signed a non-compete agreement, know that the contract does not restrict your future employment options as long as you do not violate the terms specified in the agreement.
